Violation of restrictive covenants by government is a taking of property requiring just compensation
The Kansas Supreme Court has held that restrictive covenants are "property" rights within the meaning of the fourteenth amendment and cannot be violated by government without payment of just compensation. Creegan v. Kansas, 391 P.3d 37 (Kan. 2017).
