The Ground of Scalia’s Freedom of Religion: A Contested Political Logic of American Democracy

 

My research project explores the connection between Justice Antonin Scalia’s political philosophy of democracy and his legal views on religious freedom during his tenure at the U.S. Supreme Court, and it attempts at articulating a broader truth about the nature of religious freedom jurisprudence: discorded legal opinions on freedom of religion are often influenced by one’s preoccupation with a certain politically invested ideology.
